My brake hose had burst and I throw it out.  I looked at the length I needed and it said it was 38"

I saw one on ebay for 37" will that work?. I also saw a few 40" 46" ones.. Will those work even if they are a little bigger?.

I also saw some really cheap used ones from some atvs and motorcycles. Will those work with a 50cc scooter?.

You shouldn't have thrown away the one you had cause you could have posted a picture of it.  That being said, the 38" one you linked to should work fine. The holes are the same.
